Terms of Service

Effective date: October 2, 2026. Last updated: October 15, 2026. Replaces the version of March 13, 2026.

These Terms of Service ("Terms") govern your access to and use of the Engram Kinetics platform, website, courses, and related services (collectively, the "Service") operated by Axiom Learning Systems LLC ("Company," "we," "us," or "our"), a Colorado limited liability company.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Registration

To access courses, you must create an account. You agree to provide accurate, complete information and to keep your login credentials confidential. You are responsible for all activity under your account. You must be at least 18 years old to create an account.

2. Description of the Service

Engram Kinetics provides online educational content designed to help candidates prepare for professional certification exams in exercise science and in strength and conditioning, including the ACSM Certified Exercise Physiologist (ACSM-EP), the NSCA Certified Strength and Conditioning Specialist (CSCS) and the NSCA Certified Personal Trainer (NSCA-CPT) exams. The Service includes, but is not limited to, interactive lessons, decision-training scenarios ("Engrams"), case studies, masterclasses, quick decision drills, reference sheets, practice exams, and a progress dashboard.

The Service is an educational preparation tool. It is not affiliated with, endorsed by, or officially associated with the American College of Sports Medicine (ACSM), the National Strength and Conditioning Association (NSCA) or the Canadian Society for Exercise Physiology (CSEP). ACSM-EP is a certification of the American College of Sports Medicine. CSCS and NSCA-CPT are certifications and registered marks of the National Strength and Conditioning Association. Completing our courses does not guarantee passing any exam.

3. Purchases and Payment

All purchases are processed securely through our third-party payment processor (Stripe). By making a purchase, you agree to pay the price displayed at the time of purchase. All prices are in US Dollars (USD).

Unless the product page says otherwise, a purchase is a one-time payment for lifetime access to the course or bundle you bought, including future updates to that course or bundle. "Lifetime access" means for the operational lifetime of the platform, as long as Engram Kinetics is available online. Purchases made before October 2, 2026 keep the access that was promised when they were made.

We reserve the right to change pricing at any time. Price changes will not affect existing purchases.

4. Access Through a School Program

Some schools give their students free access with a program code. These Terms apply to that access, except the sections on payment and refunds. Our Privacy Policy explains what a school program receives: group figures only, never names or individual scores.

5. Refund Policy

We offer a 7-day refund policy from the date of purchase. If you are not satisfied with a course for any reason, contact us at admin@engramkinetics.com within 7 days of purchase for a full refund.

After the 7-day period, all sales are final. No partial refunds will be issued.

6. License and Access

When you buy a course or receive access to it, we grant you a non-exclusive, non-transferable, personal license to access and use the Service for your own educational purposes. This license does not include the right to:

share, distribute, or resell your account or any content from the Service;
copy, reproduce, or redistribute course materials in any form;
use automated tools (bots, scrapers) to extract content from the platform;
share login credentials with any other person;
use the content to create a competing product or service.

Violation of these terms may result in immediate account termination without refund.

7. Intellectual Property

All content on the Service (text, graphics, interactive scenarios, code, design, and branding) is the intellectual property of Axiom Learning Systems LLC or its licensors. All rights are reserved.

We write our own scenarios and educational content. We do not reproduce copyrighted material from ACSM, NSCA or CSEP publications or from any other source, and we correct any passage brought to our attention. Thresholds and standard values cited in the content are factual data.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

the Service will be uninterrupted, error-free, or secure;
the content is free of inaccuracies (though we make every reasonable effort to ensure accuracy);
use of the Service will result in passing any certification exam.

9. Limitation of Liability

To the maximum extent permitted by Colorado law, Axiom Learning Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid for access to the Service.

10. Medical and Professional Disclaimer

The content provided through the Service is for educational and exam preparation purposes only. It does not constitute medical advice, clinical guidance, or professional recommendations. The clinical and coaching scenarios presented in the Service are fictional and designed for educational purposes. Do not use the content of this Service to make real clinical or training decisions.

11. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could harm other users or the platform. In the event of termination for cause, no refund will be issued.

12. Third-Party Services and Privacy

The Service is hosted on the LearnWorlds platform and uses Stripe for payment processing. Your use of these services is subject to their respective terms of service and privacy policies. Our Privacy Policy lists the providers that process your data and explains how we protect it.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict-of-law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in the City and County of Broomfield, Colorado.
